Terms of Service - Host Master Web LLC

1. Agreement & Acceptance

By activating a service with Host Master Web LLC, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service (ToS), as well as our Acceptable Use Policy (AUP) and Privacy Policy. This constitutes a legally binding agreement between you and Host Master Web LLC.

We reserve the right to update or change these terms at any time without prior notice. It is your responsibility to review this page periodically for updates. Your continued use of our services following any changes signifies your acceptance of those modifications.

2. Payments, Billing & Invoicing

Chargebacks or payment disputes will result in immediate and permanent account suspension. Any fees incurred by Host Master Web due to a chargeback must be paid before service restoration.

Automatic Renewals

To prevent service interruption, all subscriptions renew automatically unless a cancellation request is submitted 7 days before the due date.

Grace Period

Invoices are due on their anniversary date. After 3 days of non-payment, services are suspended. After 10 days, data is terminated.

🔄 Late Restoration Policy

If your service has been terminated due to non-payment (after the 10-day period) and you require a manual backup restoration, you must contact us within 10 days. If a backup is still available in our archive, a One-Time Restore Fee of $35.00 will be charged before the data is recovered.

3. Refund & Money-Back Policy

We stand by our service quality, but specific rules apply to refunds to prevent industry abuse:

Shared & Reseller Hosting: 30-day money-back guarantee (minus domain registration fees).
VPS & Dedicated Servers: Strictly non-refundable due to the resources allocated.
Domain Names: All domain registrations and transfers are final and non-refundable.
Crypto Payments: Payments made via Cryptocurrency are non-refundable under any circumstances.

4. Prohibited Content & Activities

Our network is designed for legitimate business and personal use. The following are strictly prohibited:

Bulk Email/Spamming operations.
IP Spoofing or Network Port Scanning.
Cryptocurrency Mining (All forms).
Hosting Child Sexual Abuse Material (CSAM).

DDoS Attack Scripts or Booter services.
Storage of Pirated/Nulled Software.
Hosting malware, viruses, or phishing pages.
Botnets or Command & Control servers.

🛡️ Zero Tolerance Policy

Any account found engaging in illegal activities or causing network instability will be terminated immediately without a refund.

Activities negatively impacting shared infrastructure stability, global IP reputation, upstream provider relationships, or overall network integrity may result in immediate administrative action including suspension, null-routing, or permanent termination without prior notice.

5. Service Level Agreement (SLA)

Host Master Web guarantees a 99.9% Network Uptime. This guarantee covers the availability of our network and power infrastructure. Exclusions include scheduled maintenance, upstream provider outages, or client-side software configuration errors.

6. Data Responsibility & Backups

CRITICAL NOTICE:

While we perform disaster recovery backups for Shared Hosting, the Client is solely responsible for maintaining off-site backups. Host Master Web LLC shall not be held liable for any data loss, corruption, or failed restoration.

7. Resource Usage & "Unlimited" Policy

Enterprise Shared Hosting environments operate with reduced account density, enhanced resource balancing, advanced caching technologies, and optimized database performance layers designed for business-critical websites and higher traffic workloads.

Host Master Web LLC reserves the right to migrate accounts generating sustained abnormal resource utilization to VPS or Dedicated infrastructure solutions where necessary to maintain platform stability for other customers.

8. Support Boundaries

Support coverage includes infrastructure-level troubleshooting, network diagnostics, hardware monitoring, and service availability assistance.

Application-level debugging, custom development, third-party plugin troubleshooting, or unsupported software configuration fall outside standard support scope unless covered by an active management agreement.

9. Limitation of Liability

In no event shall Host Master Web LLC be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities resulting from service outages or data loss.

10. Governing Law

This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of California and the applicable federal laws of the United States.

Any dispute, legal claim, or proceeding arising from or relating to Host Master Web LLC services shall be exclusively subject to the jurisdiction of the courts located within Los Angeles County, California.

By using our services, the Client irrevocably agrees to the exclusive jurisdiction and venue of the courts within Los Angeles County, California.

11. Shared Hosting Limits (Inodes & CPU)

Shared accounts are limited to 250,000 inodes. Resource usage is monitored for system stability. Accounts consistently exceeding 10% of total system resources for extended periods will be flagged for an upgrade.

12. VPS & Dedicated Server Management

Virtual Private Server (VPS) environments provide isolated virtualized resources including dedicated CPU allocations, memory resources, storage space, and operating system environments.

Dedicated Server services provide exclusive access to physical hardware resources assigned solely to a single customer account.

Clients remain fully responsible for operating system maintenance, software licensing, security hardening, firewall configuration, backup management, and server administration unless a managed services agreement is explicitly included within the purchased service plan.

Host Master Web LLC maintains responsibility solely for underlying infrastructure components including network connectivity, physical hardware operation, power delivery, and virtualization platform stability.

13. DMCA & Copyright Policy

We respond to valid DMCA notices. Infringing content must be removed within 24 hours of notification to ensure legal compliance.

14. Account Verification & Fraud

New orders are subject to manual fraud checks. We reserve the right to request a government-issued ID for verification of high-risk or flagged orders.

15. IP Address Ownership

All IP addresses assigned remain our property and may be reassigned for technical reasons or network optimization.

16. Backup Retention Post-Termination

Data is purged permanently 7 days after service termination. We do not store data for terminated accounts indefinitely.

17. Force Majeure

We are not liable for failures due to circumstances beyond our control, such as natural disasters, war, or upstream provider failures.

18. Abusive Behavior Policy

Use of abusive language or harassment toward staff leads to immediate account termination without refund.

19. Price Modifications

We reserve the right to change service prices with a 30-day notice to existing customers.

20. Anti-Spam & SMTP Policy

Spamming is strictly prohibited. Port 25 is restricted by default on all services. IP rotation for mailing is not allowed. SPAM complaints lead to immediate SMTP blocks and possible termination.

21. Zero-Downtime Migration Policy

Migration assistance is provided as a courtesy. While we aim for seamless transfers, we do not guarantee zero-downtime or 100% data integrity during the migration process.

22. Adult Content Policy

Adult-oriented content is permitted only where legally compliant with applicable jurisdictional laws and exclusively on approved VPS or Dedicated Server environments.

Shared Hosting and Enterprise Shared Hosting platforms may not be utilized for adult-oriented websites, streaming platforms, or high-risk reputation-sensitive content due to shared infrastructure and network reputation management policies.

23. Affiliate & Marketing Emails

Third-party affiliate marketing emails are strictly forbidden. Accounts identified as sources for lead generation or affiliate mailing will be suspended to protect infrastructure health.
